Welcome from the 2011 Program Chair
On behalf of ACLM President Dale Cowan, MD, JD, FCLM, and the Board of Governors, I take pride in welcoming you to our 51 st Annual Conference, Medicine and Law for Healthcare Professionals. At this conference, we are again offering a concurrent Dental Symposium for the third time in recent history.

The excellent faculty of speakers will be addressing many contemporary “hot button” topics as well as providing an in-depth look at diverse medical and legal issues. This comprehensive program will provide attendees with current information about leading advances in medicine and law, including sessions pertaining to: recent developments in state courts, federal courts and the medical-legal literature; alternative dispute resolution; online reputations; gene patenting; globalized health care; electronic health records; ethical issues of informed consent and organ donation; peer review; healthcare policy; medical education issues; community health and medical research; healthcare reform and other pertinent issues involving the practice of medicine and the law. In addition, Bruce H. Seidberg, DDS, MScD, JD, FCLM, has developed an engaging dental program to run concurrently.

Dr. Cyril H. Wecht, one of the original founding members of the organization, will moderate the annual Cyril Wecht Luncheon at which attorney Mark Geragos, Esq., will be presenting “Forensic Experts: Don’t Leave Home Without Them.” The annual S. Sandy Sanbar Lecture, given by Mitchell D. Forman, DO, FACR, FACOI, FACP, Dean and Professor at Touro University Nevada College of Osteopathic Medicine, is entitled, “Predictive Parameters of Professionalism: How to Identify and Remove the Bad Apples.” In addition, the panel discussion “Where Are We Now?” will examine healthcare reform.

Other interesting and informative scheduled social and networking events include the President’s Welcome Reception, the annual Professional Development Luncheon, the annual Women’s Leadership Breakfast and, of course, our Annual Banquet featuring Dr. Conne Mariano, author and former White House Physician.

The deadline to receive the ACLM group rate is January 27, 2011. The ACLM encourages you to make your reservation early, as the hotel and discount block may sellout before this date. After this date, reservations will be accepted on a space-available basis and higher rates may apply.

Reservations
Guest room reservations can be made by calling the hotel at (877) 244-9474. It is important that each guest contact the hotel prior to the cut-off date, identify themselves with the group and provide the hotel with their name, contact information and arrival/departure dates to receive the discounted rate.

Hotel Deposit & Cancellation Policy
All reservations must be guaranteed with a deposit for the first night’s guestroom and tax charge. If the reservation is guaranteed on a credit card, a first night’s guestroom and tax charge per guest room will be billed immediately to the cardholders account. Cancellations can be made without penalty up to 72 hours prior to the attendees’ scheduled arrival date.

Taxis
Taxicabs are available on the east side of baggage claim, outside door exits 1-4. Airport personnel are available on the taxi curb to assist passengers. Taxicabs are also available at the McCarran Rent-A-Car Center.

In late February, Las Vegas has an average low temperature of 39°F, and an average high temperature of 63°F. A sweater is recommended for cooler evenings.

REGISTRATION INFORMATION

The Executive Office of the ACLM manages registration for the ACLM 51 st Annual Meeting. Please call the ACLM office at (847) 969-0283 if you have any questions.

Early Registration Deadline
Meeting registration forms must be received by the ACLM Executive office by January 27, 2011 to receive the discounted early registration rate. All forms received after this deadline will be assessed the regular registration fee.

Registration Cancellation & Refund Policy
Registration refund requests must be submitted in writing to the ACLM Executive Office by February 10, 2011. All refund requests will be subject to a $100 processing fee. No refunds will be made after February 10, 2011.

Pre-Registrants
ACLM pre-registrants will receive a complete registration packet on-site at the registration/information desk located off the hotel lobby. The packet will include badges, social tickets, and general meeting information.

CME Accreditation Statement/Educational Needs & Objectives

NEEDS
Medical practice is guided and controlled by complex legislation, administrative rules and regulations, and Federal/State court decisions interpreting those laws. The day-to-day practice schedule of the typical physician does not allow one to maintain a working knowledge of these developments as to expansion or new trends that will change, effect, or streamline their medical practice. This meeting will provide reporting of new legislation, rules and court decisions and exploration of how it impacts the practice of medicine and ultimately, the patient.

The requirements of peer review and the process that must occur should one become involved in a medical staff review action is not always clear. This meeting will address this need by developing physician understanding of the peer review process by providing ways or examples that demonstrate where the process goes wrong, demonstrate international prospective to further expand the knowledge base, and improve the practicing physicians’ ability to manage conflict and thereby improve the quality of patient care.

The medical legal issues surrounding what is possible and allowed in medical research or the development of new ways to offer medical care is not always well understood. To address this subject, this meeting will focus on the physician’s role in research, the physician-patient relationship as it relates to defamation over the internet, and global healthcare systems.

The medical community is driving toward the expansion of patient information as a data set, stored and transmitted as part of an electronic health record. New systems are being developed at a rapid pace designed to fill this business need and each system has unique advantages and disadvantages as well as issues with compatibility across the various systems. Physicians need to understand how to examine the technical aspects, the design aspects and the implementation processes that are best employed when bringing a new electronic health record system into a healthcare market.

The popular press has exaggerated the various ethical pitfalls of organ transplantation by covering recent fringe cases and distorting the medical and law community understanding of how the organ transplantation system actually works. Physicians are often not aware of what ethical questions they are dealing with when informing patients of risks and benefits of various procedures or treatments and need to understand how to examine the various ethical issues related to organ transplantation and informed consent.

The practice of medicine is guided by published research and protocols which are constantly updated through medical literature. The average physician does not have time to maintain a detailed analysis of medical literature as it relates to fields outside their primary medical specialty. Physicians need a succinct overview of the top ten medical-legal issues presented in literature, current medical legal issues impacting the dental profession, and a surgical resident’s journey through the new work hour rules to demonstrate there is still time for appropriate training to occur.

Physicians need to be aware of current medical-legal community health issues within the practice of medicine such as genetic research, disaster response, prenatal substance abuse, and atypical antipsychotics in the elderly. This meeting will address the complex relationship of researcher and subject, review the legal issues surrounding a complex disaster response so that the involved medical community can better prepare for that eventuality, outline the current perspectives related to prenatal substance abuse with framework to address this in the future, and finally to examine the medicolegal considerations in the use of atypical antipsychotics in the elderly.

Few physicians are familiar with Alternate Dispute Resolution (ADR) and how it can be used to provide less costly and more efficient resolution of disputes. Further, healthcare institutions and those who represent their interests have limited understanding of the way in which ADR can be used to resolve disputes in a manner that will preserve the essential working relationships between the involved parties. The formation and management of Physician/Hospital Accountable Care Organizations and the implementation of the Electronic Medical Record will undoubtedly introduce new areas of disputes requiring efficient and equitable resolution. This will require a greater number of individuals to understand and become competent in ADR in health care.

OBJECTIVES
The 51st Annual conference of the American College of Legal Medicine will focus on a diverse range of current legal medicine topics. By attending this meeting, the participants should gain working knowledge in the following areas:

  1. Identify important legal medicine developments in the courts, legislature and literature
  2. Review healthcare reform, including a panel assessing facets of the healthcare industry, the legislature and the effects
  3. Analyze alternative dispute resolution techniques and collaborative law from various perspectives
  4. Describe ethical issues surrounding informed consent and organ donation
  5. Identify the process and pitfalls in the peer review process including an international prospective as well as examine professional negligence issues
  6. Illustrate techniques for better communication with angry or upset patients and examine the physician-patient relationship as effected by defamation on various rating or other internet sites
  7. Describe the medical-legal issues surrounding gene patents and medical care and research including a particular case study
  8. Identify Global Medical Health System needs and initiatives for standardization of care
  9. Describe new developments and processes related to emerging electronic health records as it relates to the process, technology and market place
  10. Assess the issues surrounding a complex disaster response, the changing environment of work hours and graduate medical education, prenatal substance abuse, and medicolegal issues in the use of atypical antipsychotics in the elderly
  11. Identify how the new federal healthcare law is intended to affect the practice of medicine and the care of patients. Evaluate the positions for and against the nation’s new federal healthcare law
  12. Identify how Alternate Dispute Resolution (ADR) can be used to provide less costly and more efficient resolution of disputes

DENTAL NEEDS
The overall program developed for the 3rd Annual Conference on Ethics and Legal Aspects of Dentistry is designed to educate the dental community on current issues that involve scientific aspects of dentistry as well as access to care. All aspects of the program ultimately relate to the art and science of dental practice.

DENTAL OBJECTIVES
At the conclusion of this meeting, attendees should be able to:

  • Identify the legal issues in dentistry
  • Describe the government’s role and the role of dental education
  • Describe ethical, moral and diagnostic issues as they relate to dental practice
  • Evaluate risk management considerations
  • Identify issues relating to patient care
  • Explain more about mid-level care and the use of live patients for licensure, issues about access to care and dental healthcare coverage
  • Electronic record keeping

CME Accreditation Statement
This activity has been planned and implemented in accordance with the Essential Areas and Policies of the Accreditation Council for Continuing Medical Education through the sponsorship of the American College of Legal Medicine (ACLM). The American College of Legal Medicine is accredited by the ACCME to provide continuing medical education for physicians.

The American College of Legal Medicine designates this live activity for a maximum of 19.25AMA PRA Category I CreditsÔ , which includes a maximum of 2.25 hours of Medical Ethics credits. All sessions denoted with “ME” are eligible for Medical Ethics credit. Physicians should claim only the credit commensurate with the extent of their participation in the activity.

The American College of Legal Medicine has reviewed this activity’s speaker and planner disclosures and resolved all identified conflicts of interest, if applicable.

CLE Accreditation Statement
The American College of Legal Medicine designates this program for up to 19.75 hours of Continuing Legal Education (CLE) credit, which includes a maximum of 2.25 Legal Ethics credits. All sessions designated with “LE” are eligible for Legal Ethics credit. The precise amount of the CLE will vary by state. Attendance forms will be distributed which may be retained for verification by your state bar association.

CERP Statement
This continuing education activity has been planned and implemented in accordance with the standards of the ADA Continuing Education Recognition Program (ADA CERP) through joint efforts between Stony Brook School of Dental Medicine and the American College of Legal Medicine for a maximum of 17.50 ADA CERP credits.
